The main provisions are as follows: First, it clarifies the primary responsibility of employers to pay migrant workers' wages. Adhering to the principles of market entities being responsible, the government supervising according to law, and social collaboration and supervision; if an employer defaults on migrant workers' wages, it should be cleared in accordance with the law. Second, it strengthens the local people's government's local regulatory responsibility. Local people's governments at or above the county level are responsible for ensuring the payment of migrant workers' wages within their administrative regions, establishing a coordination mechanism for ensuring the payment of migrant workers' wages, strengthening regulatory capacity building, improving the target responsibility system for ensuring the payment of migrant workers' wages, and incorporating it into the assessment and supervision of relevant departments of the people's government at the same level and the people's government at the lower level. Question: The field of construction projects is the focus of addressing wage arrears for migrant workers. What special measures does the "Regulations" stipulate in this regard?
Answer: The "Opinions of the General Office of the State Council on Comprehensively Addressing the Problem of Wage Arrears for Migrant Workers" (Guo Ban Fa [2016] No. 1) focuses on the field of construction projects and clarifies a series of governance measures. Based on summarizing the practice promoted in various places, the "Regulations" standardizes the entire chain and multiple links around the arrival of funds, timely allocation, and ensuring distribution, and mainly makes the following provisions: First, in response to the problem of insufficient construction funds, it is stipulated that construction units shall not start construction or issue construction permits if they do not meet the funding arrangements required for construction; construction units shall provide construction units with payment guarantees for project funds; the labor costs of construction projects shall be managed separately from the project funds, and the construction unit shall allocate the labor costs to the special account for migrant workers' wages of the general contractor in a timely and full manner in accordance with the agreement. Second, in response to the problem of wage arrears in the field of construction projects, it is stipulated that construction units have the right to urge the general contractor to strengthen labor employment management, the general contractor shall supervise the wage distribution of the sub-contractor, and the sub-contractor shall be directly responsible for the management of the migrant workers they employ; if the construction project is contracted or sub-contracted to individuals or units that do not have legal business qualifications, resulting in wage arrears for migrant workers, the construction unit or the general contractor shall pay; the general contractor shall set up a rights protection information bulletin board at the construction site. Third, in response to the problem of non-standard labor employment of construction enterprises, it is stipulated that the general contractor or sub-contractor shall conduct real-name registration management of the migrant workers they employ; the wages of migrant workers shall be paid by the general contractor on behalf of the sub-contractor; the general contractor shall open a special account for migrant workers' wages in accordance with the regulations, and store wage deposits or replace them with financial institution guarantees in accordance with the regulations, which shall be specifically used to pay the arrears of wages for migrant workers.
Question: What regulations has the "Regulations" made in terms of strengthening the supervision and management of ensuring the payment of migrant workers' wages?
Answer: Refining the regulatory responsibilities of departments is an inherent requirement for eradicating the problem of wage arrears for migrant workers. To this end, the "Regulations" make a series of provisions in terms of supervision and inspection: First, the administrative departments of human resources and social security, the competent construction departments of relevant industries, and other relevant departments shall, in accordance with their respective responsibilities, strengthen supervision and inspection of labor contract signing, wage payment, real-name employment system, special wage accounts, wage payment by general construction contractors, wage security deposit storage, and public information on safeguarding rights. Second, when investigating and handling cases of wage arrears for migrant workers, the administrative departments of human resources and social security may, upon approval, legally inquire about the financial accounts of relevant units and the real estate, vehicles, and other information owned by relevant parties. Third, in the event that employers refuse to cooperate with investigations or the responsible parties for payment cannot be contacted, the administrative departments of human resources and social security may request assistance from public security organs and other relevant departments; if wage arrears for migrant workers are suspected of constituting the crime of refusing to pay labor remuneration, they shall be promptly transferred to the public security organs for review and decision. Fourth, conduct compliance and integrity rating evaluations for employers; establish a "blacklist" of wage arrears for migrant workers, and include employers and their legal representatives or principal responsible persons, directly responsible supervisors, and other directly responsible personnel in the list of objects for joint disciplinary action for dishonesty, and impose restrictions in accordance with laws and regulations.
Question: What provisions does the "Regulations" make in terms of legal liability?
Answer: To ensure the effective implementation of the wage payment guarantee system for migrant workers, increase penalties for illegal activities, and foster a social environment where owing wages is "undesirable," "impossible," and "unthinkable," the "Regulations" stipulate the following regarding legal liabilities: First, they clarify the legal liabilities for wage arrears owed to migrant workers, urging employers to fulfill their primary responsibilities. Employers who violate regulations and owe wages to migrant workers will be dealt with according to relevant laws, meaning the administrative department of human resources and social security will order payment within a specified period. Failure to pay within this period will result in compensation to the workers of between 50% and 100% of the amount owed. If the actions are suspected to constitute the crime of refusing to pay labor remuneration, the case will be promptly transferred to judicial authorities for criminal prosecution. For illegal acts such as paying wages in kind or with securities instead of currency, failing to create and maintain wage payment ledgers, failing to provide wage slips to migrant workers, and withholding or indirectly withholding social security cards or bank cards used for wage payments, the administrative department of human resources and social security will order corrections within a specified period. Failure to correct within this period will result in fines for the entity, as well as fines for the legal representative or principal responsible person, the directly responsible supervisor, and other directly responsible personnel. Second, they emphasize the legal liabilities for illegal acts in construction projects. General construction contractors who fail to open or use dedicated wage accounts for migrant workers as required, fail to deposit wage security deposits as required, or fail to provide financial institution guarantees; general construction contractors and subcontracting units who fail to implement real-name labor employment management; construction units who fail to provide payment guarantees for project funds as required by law, or fail to allocate labor costs in a timely and full manner as agreed; and construction units or general construction contractors who refuse to provide or are unable to provide project construction contracts or relevant information on dedicated wage accounts for migrant workers will be ordered to make corrections within a specified period and fined between 50,000 and 100,000 yuan. Some of these illegal acts will also result in orders to suspend the project, reduce the qualification level, or revoke the qualification certificate. Third, they clarify the responsibilities of government departments for inadequate supervision, promoting more standardized government investment practices. If government investment projects fail to pay migrant workers' wages due to insufficient government investment funds, the administrative department of human resources and social security, upon approval by the government at the same level, will order the full allocation of the arrears within a specified period. Failure to allocate the arrears within the time limit will result in interviews with the persons in charge of the relevant departments and, if necessary, notification of the local government负责人 (fù zé rén - person in charge). In serious cases, the government and its relevant departments负责人 (fù zé rén - person in charge), the directly responsible supervisor, and other directly responsible personnel will be sanctioned in accordance with laws and regulations. Personnel from human resources and social security, development and reform, finance, public security, and other departments, as well as relevant industry engineering construction主管部门 (zhǔ guǎn bù mén - competent departments) who abuse their power, neglect their duties, or engage in malpractice for personal gain while performing their duties of supervising and managing the payment of migrant workers' wages will be sanctioned in accordance with laws and regulations; if a crime is committed, they will be investigated for criminal responsibility in accordance with the law.
