On the afternoon of June 18, 2021, the 8th lawyer business training of the Guangxi Lawyers Association Lawyer Education and Training Base in 2021 was held at Guangxi Tongwang Law Firm. Cheng Rui, Deputy Director of the Fourth Procuratorial Department of the People's Procuratorate of the Autonomous Region, and Chen Zhen, Deputy Director of Guangxi Tongwang Law Firm, jointly lectured on the theme of "Criminal Litigation Practice of Cybercrime", and more than 60 lawyers from the region attended the training. This is the first business training in the region's continuing education for lawyers this year in the form of joint lectures by prosecutors and lawyers.
Prosecutor Cheng Rui focused on "Difficult Issues in the Judicial Identification of Cybercrime", from the changes in concepts brought about by cybercrime, the challenges of cybercrime to traditional crime concepts, and the difficult issues in handling crimes that help information network criminal activities. From theory to practice, from the Procuratorate's report to judicial cases, he introduced to the lawyers the development and characteristics, key points and difficulties of cybercrime, and reminded the lawyers to change their concepts, earnestly learn new knowledge, and solve the difficult problems in the judicial identification of cybercrime.
Lawyer Chen Zhen, with the theme of "Defense Ideas for Lawyers Handling Cybercrime Cases", combined with the legislation and judicial norms of cybercrime cases, started from the three links of fact finding, conviction and sentencing, and proposed that defense lawyers should determine the defense ideas step by step, find the breakthrough point and focus point, and express them through appropriate language, so that the defense opinions can be adopted by the case-handling agency and achieve effective defense. Finally, Lawyer Chen Zhen also shared her experience of participating in the "Advanced Seminar on Difficult Issues in the Application of the Confession and Punishment Mitigation System" jointly organized by the Supreme People's Procuratorate and the Ministry of Justice.
Joint lectures and training by prosecutors and lawyers are innovative practices to deepen the benign interaction between prosecutors and lawyers, strengthen the awareness of the legal community, and improve the level of cooperation between prosecutors and lawyers. The Fourth Plenary Session of the 19th CPC Central Committee emphasized the need to build a high-quality team of legal professionals and innovate the training mechanism for legal talents; the CPC Central Committee's "Construction Plan for a Rule of Law China (2020-2025)" further clarified the need to establish a system of joint training for judges, prosecutors, police officers, and lawyers in service. The lawyers who participated in the training highly praised this "joint lecture by prosecutors and lawyers" training, saying that it was full of dry goods and benefited them a lot.
