Recipient presents a banner to Wuzhou Legal Aid Center and lawyer Zhang Bo (first from right)
"The three-year journey of safeguarding rights has finally come to an end. Thank you for your help." On April 25, 2023, the recipient, Ms. Pan, presented a banner to the Wuzhou Legal Aid Center and Zhang Bo, a lawyer from Guangxi Tongwang (Wuzhou) Law Firm who handled the case, to express her gratitude.
In September 2009, Ms. Pan joined a school through recruitment by a district education bureau, working successively as a security guard and dormitory administrator. No written labor contract was signed according to law, with only one written labor contract signed on September 1, 2019. The school had not been paying social insurance for her. When Ms. Pan was approaching retirement age, she requested the school to pay her social insurance according to law, but to no avail. Ms. Pan also reported this to relevant departments multiple times, but without a clear result. In June 2020, Ms. Pan applied to the Wuzhou Legal Aid Center for legal aid. Because Ms. Pan's family was in financial difficulty, she met the conditions for legal aid. The Wuzhou Legal Aid Center provided her with legal aid in accordance with the law and promptly assigned a lawyer to handle the case.
Although Ms. Pan's request mainly involved confirming the labor relationship and economic compensation, which did not seem complicated from the request items, the case became complex due to administrative division adjustments, changes in school names, and the fact that she was recruited by the education bureau rather than the school when she joined. The case went through a labor arbitration hearing, two rejections, one first instance, one second instance, and a retrial at the High Court. Although Ms. Pan's request was partially won in the judgment, the key request was not adjudicated.
In August 2022, Zhang Bo, a lawyer from Guangxi Tongwang (Wuzhou) Law Firm, and intern lawyer Li Xiaoman were assigned by the Wuzhou Legal Aid Center to continue handling the case. After accepting the assignment, the two lawyers carefully analyzed the case, studied the relevant materials of labor arbitration and court trial, and communicated many times through the law firm and through WeChat, telephone, etc., to clarify the key points and difficulties of the case; on the basis of full preparation, they formulated a mature and complete agency plan, and expressed agency opinions according to the actual court trial. Thanks to the efforts of the two lawyers, both the first and second instances were won, and the client obtained satisfactory results.
On April 25, 2023, Ms. Pan made a special trip to the Wuzhou Legal Aid Center to present a banner to express her gratitude, which is not only an affirmation of the professionalism and ability of Tongwang lawyers in handling cases, but also a reflection of Tongwang lawyers' active participation in legal aid to safeguard the legitimate rights and interests of vulnerable groups and contribute to society.
