In February 2019, Guangxi Tongwang (Liuzhou) Law Firm lawyers Xiao Gaoming and Meng Xiaokun, appointed by the Liuzhou Legal Aid Center, represented a legal aid case involving military rights protection. After receiving the case, after a preliminary analysis of the case, the representing lawyers believed that the driver in this case had no ability to pay, and only by letting the insurance company involved in the case bear the insurance liability can the recipient obtain subsequent compensation. Therefore, how to negate the proposed deductible matter became the difficulty of this case. After in-depth research on the case, the representing lawyers proposed that in this case, the insurance company did not explain the deductible clauses to the insured when signing the insurance contract with the insured, and the signature after the clause was not signed by the insured himself. Therefore, the deductible clause does not take effect, and the insurance company should still bear the insurance liability and compensate the recipient.
After determining the basic idea, the representing lawyers immediately filed a lawsuit with the people's court. During the court session, the insurance company expressed disagreement with the above-mentioned views put forward by our side, and also did not recognize the disability assessment report of the injured person in this case. Therefore, this case went through multiple procedures such as handwriting identification and disability assessment. Finally, after our representing lawyers collected evidence from various parties and demonstrated in court for many times, the above-mentioned views put forward by our representing lawyers were adopted by the people's court. In June 2021, after a rights protection journey of more than two years, the people's court ruled that the insurance company should bear the insurance liability in this case. Finally, with the unremitting efforts of the representing lawyers, the recipient was successfully helped to obtain more than 200,000 yuan in compensation. After receiving the compensation, the recipient and his family thanked the assisting lawyers and presented them with a banner. The case came to a perfect end.
