The Civil Code is the first law named as "Code" since the founding of the People's Republic of China. It is known as the "encyclopedia of social life" and is a fundamental law that consolidates the foundation, stabilizes expectations, and benefits the long term. On the occasion of the eighth National Constitution Day on "12·4", in order to thoroughly study and implement the spirit of the Sixth Plenary Session of the 19th Central Committee of the Party and unswervingly follow the path of the rule of law with Chinese characteristics, on the afternoon of November 30, 2021, Ou Min, director of the Marriage and Family Affairs Center of Guangxi Tongwang Law Firm, was invited by the consultant unit, the Housing and Urban-Rural Development Department of the Autonomous Region, to conduct a special lecture on the Civil Code entitled "Brightening a Better Life in the Name of Law" for all business divisions, industry associations, and retired cadres and other employees of the department. The lecture was presided over by Ye Yun, Deputy Director of the Housing and Urban-Rural Development Department of the Autonomous Region.
Lawyer Ou Min used cases to explain the law, combined with several civil cases she has handled, and gave a detailed interpretation of the relevant content of the Civil Code around four aspects: real estate transactions, loan contracts, will inheritance, and marriage and family.
In terms of real estate transactions, Lawyer Ou Min started with second-hand house sales, pre-sale house sales, and borrowing to buy a house cases, teaching everyone to identify common risk points in real estate transactions and prevention techniques.
In terms of loan contracts, Lawyer Ou Min, combined with the relevant provisions of the Civil Code on loan interest and guarantees, elaborated on the issues that people in different positions need to pay attention to in loans from the perspectives of lenders, borrowers, and guarantors.
In terms of will inheritance, Lawyer Ou Min introduced two real estate inheritance disputes to analyze the internal legal principles that even if a will is written, inheritance will also be restricted by the division of the joint property of the husband and wife and the "necessary share" system, and clarified the specific provisions of subrogation inheritance in the Civil Code.
In terms of marriage and family, Lawyer Ou Min first gave everyone a comprehensive analysis of the determination of the ownership of real estate and house purchase funds during love, pre-marriage, and marriage. Then, introducing current hot cases of marriage and family affairs, combined with the Civil Code, in terms of the ownership and return of betrothal gifts, the determination of joint debts of husband and wife, and housework compensation, we conducted in-depth discussions with everyone.
Through this lecture, all employees have enhanced their legal awareness, established the concept of the rule of law, further deepened their understanding and understanding of the Civil Code, and also improved their ability to use legal knowledge to solve problems.
