On the morning of July 23, 2021, Chen Jianwei, a lawyer, was invited to provide specialized training on the Contract Law section of the Civil Code and factoring contracts to Nanning Financial Investment Group Co., Ltd.'s subsidiaries, including Nanning Huaxin Microfinance Co., Ltd., Nanning Jinkong Commercial Factoring Co., Ltd., Guangxi United产权 Exchange Co., Ltd., and Nanning Jinkong Asset Management Co., Ltd. Liao Weixiong, Chairman and General Manager of Nanning Huaxin Microfinance Co., Ltd., Zhong Yunping, General Manager of Guangxi United产权 Exchange Co., Ltd., Luo Yingying, Deputy General Manager of Nanning Jinkong Asset Management Co., Ltd., along with other leaders, department heads, and over thirty lawyers from the group company, were in attendance.
Lawyer Chen Jianwei first organized and summarized the key legal provisions of the Contract Law in the Civil Code, and explained the basic legal theory of contracts in a simple and profound way, so that the participants had a clear and accurate understanding of the basic elements of a contract, the establishment, formation and effectiveness of a contract, and liability for breach of contract. Subsequently, lawyer Chen Jianwei focused on interpreting the provisions of Chapter 6 of the Contract Law of the Civil Code (i.e., transfer of creditor's rights and debts), which is closely related to the participating units, and through a detailed interpretation of the legal provisions, combined with the business scope of the participating units, he put forward solutions to the problems encountered in practice, and focused on reminding the risks that need to be prevented in the operation. Finally, lawyer Chen Jianwei gave a detailed explanation of the factoring contract, which is the focus of attention of the participating units. Factoring contract is one of the typical contracts newly included in the specific provisions of the Contract Law of the Civil Code, and it is also one of the contract types for the factoring business that the participating units will carry out in the next stage. Lawyer Chen Jianwei used vivid and humorous language to explain the theoretical knowledge and practical operation details of factoring contracts, the mixed operation of financial leasing contracts and factoring contracts, etc., and combined with actual cases, he further explained the risk points that need to be paid attention to in actual business and specific countermeasures, etc.
