On the morning of March 13, 2020, the administrator of Guangxi Nanning Fengdeng Chemical Co., Ltd. organized a resumption of work and production promotion meeting in front of the company's factory office building to explain how to solve the issues of unpaid wages and social security, and to listen to the opinions of the majority of employees. In order to deal with the impact of the current unresolved COVID-19 epidemic, and to cautiously ensure that epidemic prevention and the resumption of work and production are carried out simultaneously without any mistakes, the meeting was conducted in the form of an open-air dialogue and discussion. At the meeting, Ye Jianhan, the head of the administrator, senior partner of Guangxi Tongwang Law Firm, and director of the Enterprise Bankruptcy and Reorganization Legal Affairs Department, explained the recent progress made by the administrator in promoting the resumption of production and operation under the guidance and supervision of the Long'an Court, and informed the employee representatives present about Yuke Xin Company's acquisition of the qualification and term of the investor in the resumption of production.
Subsequently, Wei Maojun, the general manager of Yuke Xin Company, made a statement on behalf of the investor regarding the preparation of funds for the resumption of production, the wage plan, and the appointment of key personnel, and reiterated to the representatives present the company's commitment to invest no less than 8 million yuan for the resumption of production.
At the meeting, Ban Gang, the director of the County Bureau of Economy, Trade and Information Technology, pointed out that the county party committee and the county government have high hopes for Fengdeng Company to resume production as soon as possible. Only when production is restored and the enterprise is reorganized and survives can the legitimate rights and interests of the majority of employees be guaranteed to the greatest extent. Currently, Yuke Xin Company, as an investor in the resumption of production, is solving the problem of starting Fengdeng Company's ability to resume production and operation. It is hoped that the majority of employees can correctly understand the relationship between resuming production, solving employment, and solving historical legacy issues, actively seek employment, cooperate with the resumption of production, and strive to start the factory as soon as possible, so as to provide the necessary productivity guarantee for the gradual resolution of historical legacy issues in the future.
Shi Tongzeng, deputy director of the County Human Resources and Social Security Bureau, stated that the social security department has declared its claims to the administrator in accordance with the law. The company's unpaid social security contributions to employees will be cleared through reorganization in the future. With the coordination of the county party committee and the county government, the human resources and social security department will actively cooperate with the court, various functional departments, and the administrator to strive for the most favorable solution from higher-level competent authorities within the scope permitted by policies and regulations, so as to properly resolve the outstanding social security issues of concern to the majority of employees.
At the meeting, Yang Yang, a judge of the County People's Court, explained to the employee representatives the solution to the unpaid wages before and after Fengdeng Company entered the reorganization procedure, clarified the source of funds and conditions for the recent payment of some unpaid wage benefits, and pointed out the future trial direction of the reorganization case to the representatives present. Judge Yang Yang emphasized that the work of recruiting reorganization investors will be promoted in an orderly manner in the near future, and the original employees of Fengdeng Company have the right to choose whether to continue to be employed in Fengdeng Company. If they choose to return to work, the wage benefits after returning to work will be immediately implemented by Yuke Xin Company under the supervision of the court and the administrator, so as to effectively protect the legitimate rights and interests of the employees who return to work and resume work.
